Presentation Overview
In Canada, commercial electronic messages (CEMs), including e-marketing through text messages, e-mails and some social media, are governed by Canada’s federal anti-spam legislation (CASL). While CEMs are often used for a variety of legitimate business purposes, including customer support and e-marketing, failing to comply with CASL can carry significant risks and penalties for companies, associations and other types of organizations.
Since CASL came into force in 2014, we have regularly helped clients comply with CASL and avoid making common types of CASL compliance errors. Also, the CRTC, which is primarily responsible for the administration and enforcement of CASL, has consistently enforced CASL since it came into force, with significant penalties imposed against both companies and individuals. Regular issues that arise relate to core CASL requirements (e.g., consent, meeting the elements of the different types of implied consent and an unsubscribe mechanism).
It remains important for marketers to not only understand the core requirements of CASL, but also how to avoid violations in relation to specific types of marketing (e.g., friends and family promotions, marketing involving partners or affiliates and B2B marketing).
This interactive presentation will provide a brief overview of CASL, including its application, enforcement and penalties. The focus of the presentation will be specific types of CASL compliance errors we regularly see and how to avoid them, including in relation to consent requests, requesting consent for third party senders, using third party lists and directories, B2B marketing and friends and family type promotions.
